These Terms of Service (“Terms”) govern your access to and use of mumbaiarthouse.com (the “Website”) and any purchase you make through it. The Website is owned and operated by MUMBAI ART HOUSE ENTERPRISE PRIVATE LIMITED, a company registered under the laws of India with its registered office at 6. 3 Floor, CAPITAL, SR no 656, Plot 387, Pandit Colony, Nashik, Nashik, Maharashtra, India, 422005. By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website.
1. About Mumbai Art House
Mumbai Art House is an online platform for the sale of original artworks, including paintings, drawings, photography, sculpture, and mixed-media works, created by independent artists. Each artwork listed is sold as a one-of-a-kind, original piece unless otherwise stated on the product page.
2. Eligibility
You must be at least 18 years of age, or the age of legal majority in your jurisdiction, and capable of entering into a legally binding contract to use this Website and make purchases.
3. Account Registration
You may be required to create an account to complete a purchase. You agree to provide accurate, current, and complete information and to keep this information updated. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
4. Products, Pricing & Availability
- Each artwork on the Website is offered subject to availability. As original works are one-of-a-kind, once sold, an identical piece cannot be reordered.
- Prices are listed in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST) unless stated otherwise.
- We make every effort to ensure product descriptions, images, dimensions, and pricing are accurate. Colours may appear slightly different due to variations in individual screen displays. We reserve the right to correct any pricing or listing errors, and to cancel and refund any order affected by such an error, before or after order confirmation.
5. Orders & Payment
Payments made through the Website are facilitated through Nimbbl's payment infrastructure and may be processed by Nimbbl and/or the applicable payment gateway, payment aggregator, acquiring bank, card network, UPI service provider or other payment service provider integrated through Nimbbl.
We do not store your complete payment card details, UPI authentication credentials, CVV, PIN, OTP or net banking credentials on our servers.
An order is confirmed only once payment has been successfully authorised and captured or otherwise confirmed through the applicable payment processing system.
We reserve the right to refuse or cancel any order, including in cases of suspected fraud, pricing errors, duplicate transactions, payment failure, payment reversal, or unavailability of the artwork.
If an amount is debited from your account but the corresponding order is not successfully confirmed, or if a transaction remains pending, delayed or requires reconciliation, the transaction may be verified with Nimbbl and/or the applicable payment service provider.
Where the transaction is confirmed as unsuccessful and the amount has been received by Mumbai Art House, the amount will be reversed or refunded to the original payment method in accordance with the applicable payment-provider and banking timelines.
You agree to provide reasonable transaction details or supporting information where required for reconciliation, refund, fraud review or dispute resolution.
6. Shipping, Returns & Refunds
Shipping timelines, packaging, damage claims, cancellations, returns and refunds are governed by our separate Shipping & Returns Policy, available on the Website, which forms part of these Terms.
Approved refunds are ordinarily made to the original payment method and are subject to the processing and settlement timelines of the relevant bank or payment service provider.
7. Authenticity
Mumbai Art House takes reasonable steps to verify the identity of the artist and the authenticity of each artwork represented on the Website before listing.
Where provided, a certificate of authenticity accompanies the artwork, confirming the artist's name, title, medium, and date of creation.
8. Intellectual Property
Unless otherwise agreed in writing, copyright in each artwork remains with the artist.
Purchase of a physical artwork does not transfer any copyright, reproduction rights, or other intellectual property rights in the work to the buyer.
All content on the Website, including text, images, logos, and design, is the property of Mumbai Art House or its licensors and may not be copied, reproduced, or used without prior written permission.
9. User Conduct
You agree not to:
- Use the Website for any unlawful purpose or in violation of these Terms
- Attempt to interfere with, disrupt, or gain unauthorised access to the Website or its systems
- Upload or transmit any harmful code, or engage in any activity that could damage, disable, or impair the Website
- Use any content from the Website, including artwork images, without authorization
10. Third-Party Links
The Website may contain links to third-party websites or services that are not owned or controlled by Mumbai Art House.
We are not responsible for the content, policies, or practices of any third-party websites.
11. Disclaimer of Warranties
Subject to applicable law, the Website and its content are provided on an “as is” and “as available” basis.
Nothing in these Terms excludes, restricts or limits any warranty, right, remedy or protection available to a consumer that cannot lawfully be excluded or restricted under applicable law, including applicable consumer protection laws.
12. Limitation of Liability
To the fullest extent permitted by law, Mumbai Art House and MUMBAI ART HOUSE ENTERPRISE PRIVATE LIMITED shall not be liable for indirect, incidental, special or consequential damages arising out of or in connection with your use of the Website or purchase of any artwork.
Subject to any non-excludable rights or remedies under applicable law, our aggregate liability for a claim arising from a particular order shall not exceed the amount paid by you for that order.
13. Indemnification
You agree to indemnify and hold harmless Mumbai Art House, its officers, employees, and affiliates from any claims, damages, losses, or expenses arising from your breach of these Terms or misuse of the Website.
14. Termination
We reserve the right to suspend or terminate your access to the Website at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, Mumbai Art House, or third parties.
15. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India.
Any disputes arising out of or in connection with these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the courts at Mumbai, Maharashtra, India.
